With the launch of Warcraft III Reforged, Blizzard has published its updated terms and rules for Reforged. Among those, some rules regarding the new World Editor (Warcraft III Mod engine) have left modders around the world upset with Blizzard.

The major toolsets of the Warcraft III editor are accessible via the Module menu. They are: Terrain Editor: Modify map geometry, place units and doodads, define regions. Trigger Editor: Manage map scripts as well as custom events and triggers. Sound Editor: Export/import sounds and music and manage audio assets. 1. Ownership Custom Games are and shall remain the sole and exclusive property of Blizzard. Without limiting the foregoing, you hereby assign to Blizzard all of your rights, title, and interest in and to all Custom Games, including but not limited to any copyrights in the content of any Custom Games. If for any reason you are prevented or restricted from assigning any rights in the Custom Games to Blizzard, you grant to Blizzard an exclusive, perpetual, worldwide, unconditional, royalty free, irrevocable license enabling Blizzard to fully exploit the Custom Games (or any component thereof) for any purpose and in any manner whatsoever.
3. Use of Third Party Content in Custom Games. You represent and warrant that neither the content you use to create or incorporate into any Custom Games, nor the compilation, arrangement or display of such content (collectively, the “User Content”), infringes or will infringe any copyright, trademark, patent, trade secret or other intellectual property right of any third party.

The Ownership clause basically renders Blizzard owner of every custom game created with the Warcraft III Reforged World Editor, while the other clause prevents players from using assets with copyright protection in custom maps (likely because Blizzard would not be able to own them that way).
Overall, the new EULA is more 'mature' in terms of expectations from the mod community. There clauses as well that modernize the distribution of mods and prohibit limitation on the distribution of any maps (i.e. donors or Patreon-only maps). However, Blizzard permits mod creators to collect funds from donations to help develop mods, as long as that process doesn't grant any 'early access' privileges.Warcraft

The Dispute over 'DotA' by Blizzard and Valve


These clauses come to a shock by the Warcraft III modding community. The original EULA, written all the way back in the early 2000s and before the modding scene for WC3 became popular, was very lax. These new restrictions likely come from the infamous Blizzard Entertainment v. Valve Corporation Trademark dispute over DotA in 2012. In this case, available online, Blizzard states the copyright power of their World Editor:

The EULA prohibits the use of Warcraft III or the World Editor for any commercial purpose without Blizzard's prior written consent. In addition, the EULA restricts any distribution of 'New Materials on a stand-alone basis... through any and all distribution channels, including, but not limited to, retail sales and on-line electronic distribution without the express written consent of Blizzard.'

Warcraft 3 world editor crackWhile characters, textures, and most of the base elements of Warcraft III World Editor were trademarks and copyrights by Blizzard, the mods created, either using them or using custom units that could be created in the World Editor, didn't belong to Blizzard. If this new EULA was in place for the original World Editor, Blizzard could've won a court case against Valve over the rights to DotA, forcing Valve to rename and rework aspects of their successful MOBA.

At the end of the day, these changes disappoint many WC3 creators and players, they protect Blizzard in future possible lawsuits, but limit the possible scope of mods both in creative and financial ways. To end this article, I'll leave a quote from Blizzard's own Rob Pardo, made during the announcement of the settlement over the copyright of 'DotA' in 2012, which seems so long ago now.
